GLASGOW ADVICE AGENCY – LEGAL TEST CASE UNIT

Glasgow Advice Agency is delighted to announce the formation of their “Test Case Unit” with an official launch due to follow in April 2013

In light of the many new and forthcoming welfare reform changes, GAA feels that it is necessary to establish a unit which will be in a position to challenge decisions which could be overturned in the courts.

During 2013 we will see an array of benefit changes, including the introduction of the Bedroom Tax which is likely to affect around 14,000 tenants and the Benefit Cap affecting 500 families in Glasgow.

We will also see changes to the Discretionary Social Fund with the responsibility being moved to Glasgow City Council, Council Tax Benefit being replaced by Council Tax Reduction Schemes, Personal Independence Payment replacing Disability Living Allowance and the introduction of Universal Credit.

At a time of unprecedented changes, GAA wants to ensure that all legal options are explored and that we support claimants in testing the new laws to ensure that their incomes can be maximised by the most favourable interpretation of the law.

Although it is important to appeal every case where possible (subject to resources), it may be more effective to fight test cases which, if successful, will reduce the need for appeal at local tribunal level.

Where there is no underlying right of appeal, it is important that Advice Agencies understand that Central Government and Local Authority decisions can be challenged by using Judicial Review and again the most just and efficient way is to identify test cases that can be taken forward.

Stop the unfair and cruel re-assessments via ATOS for disabled people currently on Incapacity Benefit. ESA is a flawed benefit, and puts terrible pressure and stress on vulnerable people, putting people who cannot work on lesser benefits and applying sanctions. Let disabled people decide for themselves if they can work, they and their carers know best.
