Although the government will do all it can to deny any rights and legal aid for recompense or court action against ATOS or the DWP, it is time for many more to attempt to take action against their ludicrous, grossly purposely unfair system! It is the only way to change this media and politically led insanity.

Bless him! This is great news (hopefully), because once a precedent is set, (if he wins), it’ll open the floodgates and Cameron will have no choice but to back down. This is exactly what it needs – challenges through the courts.

Good Luck to Patrick and his case. I have been fighting the DLA Tribunal to overturn their previous decisions, now I am to have an oral upper tribual hearing to see if it will overturn the original decision. I too faced lies and victimisation from their panel and refuse to accept their findings.

Now I will have to travel 100 miles to attend this new hearing in January, and come hell and high water, By God, I’m going to have my say, too!

you go jim i will be thinking of you, as im sure many of us will, stand up to the bullys, its all we can do, our army will grow, we have each other , its barbaric and cruel, i am seriously ill, i have a son of 27, with special needs, and haemophillia, no place of work would be insured to employ him, if he was to injure himself, he would have to arrive by blue lights, in minutes, to one hospital, the royal london, iv just done his forms, i feel sick, with the worry already, but trust, i will fight for my son, until my last breath, what a terriable time, you and every one has had, good eventually overcomes evil, to me cameron is evil.

They will kick it in to the log grass the way do with every thing and hope he dies. Every one knows now the government fully understands the tests employed by Atos are unfair and designed for no other reason than to get people off benefit , that is exactly what they are paid for by the government to do . If the sick and disabled die because of it as far as they are concerned so much the better . The whole assessment is to save money so they can give more tax cuts super rich.

  5. Jo Yelland says:

Good luck to him! Hopefully, this case will be the first and will successfully set a precedent. I hope it can also be used to persuade the ICC to look into the case put before them against IDS, Cameron, Osborne et al too!

  6. DAVID SHAW says:

ATOS……..unlawful…………..WCA……….unfit for purpose……….surely not. The tories are in charge of this whole thing so it must be perfect. Just ask anyone of these fools……Grayling, McVey, Miller, Cameron, Duncan Smith, these people are NEVER wrong.

£100 is a truly ridiculous compensation for the stress and the psychical ill-treatment suffered.

    1. Boadacia! says:

Agreed! Think what McAlpine received for his stress for being wrongly accused. Why should it differ:?

He needs a good barrister, and take them to town!

  10. Sarah says:

Good on you mate – we’re all behind you. I’d give you a hug if I could. I am lost for words at the cruelty so many disabled people are facing in the hands of Atos and the Government who employ them and turn a blind eye to the distress being caused. Some disabled people are considering suicide. Are human lives worth nothing to them?

Wishing Mr Lynch great success in his fight!
And wish there was a punishment to fit the crimes David Cameron, Iain Duncan-Smith, George Gideon Osborne, Chris Grayling, Maria Miller, Esther McVey, Nick Clegg, Danny Alexander,.Vincent Cable and every other MP who allowed the abuse and killing, who has stood by and seen the vulnerable people of this country fall farther and farther into destitution…….let’s get these parasites, these scroungers, to obey ONE paymaster, US, and to get big business and fatcats out of government once and for all.

  12. Aletheia says:

Good luck My Lynch, many people will be watching this with interest and hopeful of a positive outcome for you.
quote from article DWP:”We have already made substantial improvements to the process.”
Of course you have, you have improved it by making it harder for genuinely disabled or sick people to claim benefits!!

Seems we just do not learn from history. One only has to watch 3 minutes of X Fuctor or any of the soaps, to feel like giving up on the masses ever being educated. This is just what the politico’s know, and rely on, and how we are in this present situation.

  15. Fazzer says:

I am embroiled in a similar case where the ATOS so called doctor has lied about the content of my assessment, fabricated discussions, ignored substantial medical evidence and all after stating he agreed with an assessment he made 13 months earlier which was approaching some degree of fairness.

The system is without question corrupt with ATOS doctors on peace work and performance related pay.

Truth and factual evidence based reporting wont pay these second rate doctor’s bills, so they are aided and abetted to lie by the DWP and ultimately multimillionaire Tories sending out the directives.

We need a joined up approach to sue the parties involved. It is tantamount to premeditated murder putting people back into work when they are unfit and die as a result.

The evidence of independent qualified professionals is being ignored by second rate ATOS staff.

Lets face it, by the time disabled people get to ATOS most of the work assessment has been done by consultants who are hopefully not being bribed by Cameron and Ian Duncan Smith.

Why isn’t Vicarious liability playing a part in these ludicrous corrupt decisions?
