A 47-YEAR-OLD man overdosed on a cocktail of drugs after he had his benefits stopped because he was not given a proper medical assessment by the Department for Work and Pensions, an inquest heard.
Edward Jacques was found dead in his house in Loughborough Avenue, Sneinton, on September 25 last year. He had a history of self harm and depression, which stemmed from physical and emotional abuse as a child, the inquest was told.
Mr Jacques’ family told the Post they considered the decision to stop his benefits was a “major trigger” in a spiral which led him to overdose on heroin, cocaine and alcohol.
Mr Jacques was told his benefits of £90-a-week would be stopped on September 18 last year, the same day he took to social networking site Facebook to vent his frustration at Prime Minister David Cameron and Atos – the company which carries out medical assessments on behalf of the Department for Work and Pensions.
The assessments determine whether a person is eligible for employment and support allowance.
After writing of his disapproval of the system he wrote on Facebook:
“It’s time to say goodbye, goodbye.”
At his inquest, which lasted two days, the court heard that Mr Jacques’ medical assessment took just 23 minutes and his allowance was stopped despite him suffering from HIV, hepatitis C, sciatica, severe depression, insomnia and dental pain.
The Nottinghamshire coroner, Miss Mairin Casey, branded it a “crude assessment”.
She said:
“I find the assessment process in Edward’s case did not fully or properly reflect Edward’s physical and mental health at that time.
“It is conceded by those involved in the [assessment] process that if the information as to Edward’s physical and mental health as shared by his GP had been known at the time of the assessment, the outcome would have been very different. It is desperately sad that such evidence was not available either to the nurse or to the decision maker.”
Mr Jacques’s GP at Sneinton Dale Surgery, Dr Prit Chahal, said that the assessor arrived at a conclusion which was “not in line with his professional view” of his patient.
Giving evidence on behalf of the Department for Work and Pensions, Jag Sanghera, said:
“The more evidence that is sought the easier the decision maker’s job.”
Mr Jacques’s elder brother, Richard Jacques, 58, and his twin sister Margaret Hudson, 48, said:
“We have no doubt that the decision to stop his allowance was a major trigger which led him on to a severe depression and desperate action.
“We do not believe that Edward is an isolated case and we think thousands of assessments have been made like this across the country.”
Miss Casey recorded a narrative verdict.
She said:
“Edward Jacques died as a result of central nervous system depression following a drug overdose and alcohol consumption. It is not possible for me to say if he intended that this action would result in his death.”
A DWP spokesman said:
“Our sympathy goes out to the family of Mr Jacques. A decision on whether someone is well enough to work is taken following a thorough assessment and after consideration of all supporting medical evidence from the claimant’s GP or medical specialist. The percentage of people entitled to employment and support allowance is now at its highest level with over half of people completing a work capability assessment eligible for the benefit.”

Unfortunately its the sad reality of a system hijacked by a hidden (rightwing) agenda to relise a negative result and socail impact on the weakest members of society. Its class warfare being waged by economic fascists, who I prefer to call the “unholy Tory Trinity” for collectively their achievements can seriously compete with “the angel of death”.
The one aspect I find most distasteful is Ducan Smith’s glee at the effects his reforms are having (Death rate from suicide 72 per week in 2012 now increased to 104 a week in 2013)…He is an imbecile when it comes to having eithier emotional intelligence or a sense of moralistic guilt – he strikes me as the nasty little kid who pulls the legs off of spiders just to see it suffer from the inflicted handicap…….Sadly the disabled people who are retreating into a dark place where they kill themselves, aren’t the ones who are trying to affect or control a mental disorder. It will be the ones who largely cannot look after themselves and totally unprepared for the vicious attack a medical examination by Atos represents…nor the complete dis-regard for their “duty of Care” responsibility of the DWP, who by all accounts are recieving advice from a American Insurance corporation which has been labelled “Criminalistic” and “Totally immoral” by their own government for tactics used to avoid policy payouts and these are the people who want to destroy welfare’s protection remit and privatise Unemployment provision with policies they intend to sell to the working public who have aided the government (By benefit scrounger, disabled hate speak) in enslaving themselves to a company who intends to charge a damn sight more than your national insurance contribution and thus entitlement to supportive welfare costs…reference privatisations so far Communications, power supply, public transport, water, ect…..I challenge you to highlight any of them that has rewarded the public in terms of lowering prices or improving services? by looking to the past, you can easily predict the future in regards to welfare!
As to Cameron, why would he enguage with a criminal corporation and assign them to advising the DWP on how to abuse their client base, to whom they owe a duty of care. If it wasn’t likely to be something like a decent “Party Contribution” that had an excessive amount of 0000000’s after it?
i was assessed by atos in 2011,i was awarded zero points,i complained to atos stating their assessor was not qualified enough to understand the conditions i suffer from. atos replied admitting they assessed me incorrectly,im waiting to see what the dwp do with me now.even though the dwp reconsidered my case several times themselves,but each time turning me down.i went to appeal and won my case for esa,but all this took 2 years of fighting,very mentally draining and very frustrating,and i fully sympathise with people who were crushed by the unsympathetic actions of atos and the dwp.
i’m going to my tribunal this month..
after waiting over a year in total taking into account the atos… so called medical…in 2012… its like i have had a year of my life frozen…can you tell me if i dont win this appeal… can i take it to a higher tribunal? or must i re-apply for esa?
Nick, the law cannot support I am afraid what your getting at. If you read the statute it is really about a person helping someone else commit suicide, not about who may have inadvertantly caused it. If that was the case every bastard person who drove someone to suicide would be locked up. Over the years there would have been hundreds of thousands of them.
I use inadvertently with caution, and i hope you get my drift. This government it seems, is driving people to suicide. They could never be found to have criminal liability under that act. Ps I am one of the people under review.
I will inform senior UN officials about this tragic suicide. We should also consider petitioning Mr. Keir Starmer, QC, Director of Public Prosecutions, and recommend that his office, as well as law enforcement agencies in the United Kingdom, investigate whether criminal charges should be filed against Atos Healthcare UK under various legislative acts, including the Corporate Manslaughter and Corporate Homicide Act 2007.
The DWP and its ministers should, as well, be criminally investigated since they supervise the Atos contract and created the descriptors which Atos employs in its assessments.
There have been recent suicides and suicide attempts related to the draconian welfare reforms. The crisis for Britain’s sick and disabled is worsening and we must take immediate action.

Chris Grayling: The work capability assessment was developed in 2008 with the assistance of technical working groups. As you may be aware, the Government consult widely with stakeholders and sources of public and private sector expertise, to ensure that its policies are evidence-based. Two Unum employees, a doctor and an occupational therapist, were invited to join the technical working group that carried out the review of the personal capability assessment. As with all members of the technical working group they were appointed as recognised experts in benefit assessment and in supporting return to work for people with disability.
I can confirm that since the initial review of the personal capability assessment as part of the technical working groups, that representatives of the company, Unum, have not been involved in either the administration or review of the work capability assessment.
The Department of Work and Pension has also not engaged with Unum in the design or administration of the appeals process.

Geoffrey .. Dig deep into the Faculty of Occupational Medicine (registered as an independent charity) and you will find that they too are a member of the same Atos family along with their partner the Royal College of Physicians of which the FOM is a faculty member of, and living rent free in the same accommodation.. By both groups distancing themselves and pertaining to be a different organisation from Atos/Unum they can gain additional seats on government advisory panels, give support to policies, and be additionally consulted on new legislation to give strength to the intended changes., all whilst being part of that same group.
In 2009 the FOM held their 30th Anniversary celebration at the House of Lords supported by their sponsors Serco and Atos Healthcare..
Occupational health services serving more than 1,000,000 Government and private employees had achieved SEQOHS accreditation by October 2012. this is managed by the Royal College of Physicians (RCP) on behalf of the Faculty of Occupational Medicine (FOM). Staff working for some of the country’s biggest employers are receiving occupational health advice and support from accredited services; this includes 1,000,000 staff looked after by ATOS healthcare. A hint came from Cameron when he said “We are all in it together.”.

This week the sixth International Forum on Disability Management, IFDM 2012, takes place at Imperial College London. It is sponsored by some of the world’s largest medical insurance companies, Unum among them, and speakers include DWP chief medical adviser Dr Bill Gunyeon and Professor Sir Mansel Aylward, formerly DWP chief medical adviser and director of the Centre for Psychosocial and Disability Research at Cardiff University, which was sponsored by Unum from its inception in 2003 until 2009.
Unum’s website states that during this sponsorship period “a series of papers was published, identifying the range of factors that determine why some people become long-term absentees”. The Cardiff papers advocated a “biopsychosocial model” of disability which Unum says “informed its approach to medical underwriting”. It is the same approach upon which the current Atos work capability assessment (WCA) is based. Concomitantly, the company were advising the UK government on welfare reform.

In your email you asked to be provided with information answering the following questions:-
I am writing to request an internal review of Department for Work and Pensions’s handling of
my FOI request ‘”Bouncing Bill’s Circus of Death and Despair”‘.
Given that the contract between DWP and ATOS has been kept secret from the public, the
percentage of examination failures is astronomic, one must come to a conclusion that
wrongdoing is apparent.
Disability benefits are being stolen from claimants due to pressure from within your
organisation.
Bill Gunnyeon is mandating deprivation and death of those most weakest in society, a form of
Ethnic Cleansing, in breach of the Human Rights Act, i therefore request an internal review.
Please be assured that your request has been given our full consideration and that all aspects
of your review were taken fully into account.
The review was conducted by an independent official of the Department, of the relevant grade
and authority to carry out such requests. The case has been examined afresh, and guidance
has been sought from domain experts to ensure all factors were taken fully into account
In your request, FoI 1141, you asked for the percentage of claimants that ATOS were
instructed to fail to deprive them of their disability benefits. The response explained that Atos
Healthcare do not have targets to reduce the number of claimants on benefit, it also explained
that they do not have any role in the benefit decision making process.
I can further add that FoI is about supplying recorded information held by the Department; it is
not to explain things or confirm whether your assumptions are correct or not.

As you may or may not know the Crown of Great Britain no longer has any legal power at all to remove laws or governments, or to interfere with the running of this country. You have Oliver Cromwell who instigated the elections of MPs to the houses of parliament.
Its a crying shame, atos and this government dont care about the sick or disabled people, I dont know how they expect people to work when they have an illness, they wont stop until there is no beneft system or nhs, the government want to get rid of both of these. Atos assesments are not carried out by specialist consultants and how can they make a decision when they dont know how people live and suffer with there illness or disability day in day out, in pain every day. They aint got a clue, all they are interested is getting everyone in to work, there arnt any jobs, and thats another thing they want people to work for nothing. They dont live in the real world. How can someone go for an assessment and get a decision back in less than a week.
People with medical evidence should be left alone.

Glad tidings of great joy i bring, what a load of crap!
One of my friends came round this morning and helped to remove two panels out of my fence. These two panels represent my heating over the winter period, maybe the rest will have to come down.
Being disabled brings all the merits of a civilised society, especially a disability for life, what i had till having it stolen from me by a terminator, EMMA BRODRICK, an ATOS terminator.
First they took my Incapacity Benefit then came and took my Disability Living Allowance.
The DWP say that they can do this as my circumstances have changed. I have never reported a change, only the ATOS report……………..
My circumstances have changed, “THEY STOLE MY BENEFITS”
Originally my benefits were awarded at a medical tribunal following an accident at work. The tribunal was attended by two doctors, each having a raft of qualifications after their names, the ATOS nurse had done a short course……………
They have no qualifications that any of the medical councils recognise……..
The doors are beginning to stick due to the damp in the air, winter is on its way. Nevertheless my family will manage. We have to, its not a matter of choice.
We have not lit our gas fire for a long time now, indeed this will be our fourth year without heat. I explained this to my ATOS nurse but she must have forgot to put it on my biased report.
Strange it being omitted?
Mind you, she will be celebrating in style with the wages of sin she has amassed. I wonder if any of her clients have died?
Christmas last year was a time to celebrate, we had a meagre benefit then, this year will be a trial to stay alive.
The pieces of wood from my fence will be burnt in the flue area that used to be occupied by my gasfire, an ornament from the good days. There is an old flagstone on what is left of the carpet, directly below my little fire. It should stop a lot of the sparks.
Going to the toilet is fun, you have to use the lit candle to maneouvre your way there, cannot afford to use the electric.
Ice forms on the inside of your doors and windows but the old coats thrown on the bed help keep the hypothermia at bay.
Hypothermia, apparently is a good way to die, you don’t realise your life is being taken away, similar to the actions of the DWP………………..
My son goes to a sixth form college now, the bus fare is a pound each wayor one meal less, as we see it. We feed him best we can but his friends, whose parents are not shirkers, give him their leftovers……….
Christmas dinner will be an anticlimax. You can hardly don party hats and celebrate.
As the privileged watch giant plasma screens and scramble to open presents, we will be huddling to keep warm, weighted by our old fleeces,whilst keeping an eye on the thermometer.
Any food we get will have been given by a good samaritan.
Our son realises that we love him so much, even though we can’t afford to buy him any gifts. His gift is the gift of life…………..
As the government turn a blind eye to the energy companies obscene act of raising profits for the bosses and shareholders, the old pass away in droves. It will not bother any ministers either, their expenses will suffice nicely to enable a sugar coated festivity.
The government rhetoric about impressing upon the energy companies to show their lowest tariffs, is no good to the people who cannot afford energy.
The only warmth they will feel is the giant gas flames engulfing their bodies in the the crematorium…………………………
Talking of crematoriums, why haven’t the coalition brought these in yet, they have introduced all the other doctrines of the NAZIS against the weakest and most vulnerable.

This is a COLOSSAL tragedy, poor Mr. Jacques. I wished I could have conversed with him before this heartbreaking tragedy; simply to let him know that he was NOT ALONE trapped inside this EVIL WEB of government CORRUPTION. The lying, evil, corrupt DWP simply told me that they want me dead in order for them to SAVE MONEY. I have a long term depressional illness and I intend to fight them legally through the law courts. The CALLOUS DWP has NO SYMPATHY for anyone.
